This claim was submitted for decision based upon the allegations in the Notice of Claim and Respondent’s Answer.
Claimant seeks to recover $3,226.56 for providing a professional digital mailing system, a postage machine, for use in the Respondent’s Phillipi District Office, pursuant to a contract with the Respondent, West Virginia Department of Health and Human Resources, Office of Environmental Health Services, as documented by unpaid invoices.
In its Answer, Respondent admits the validity of the claim only as to the sum of $2,419.92 and further states that there were sufficient funds expired in that appropriate fiscal year from which the invoices could have been paid. The Respondent denies the validity of the claim as to the sum of $806.64, asserting that one of the invoices had already been paid during the pendency of the contract, there was a double billing on a second invoice and the remaining disputed invoices covered rental time periods that occurred after the contract expired
The Claimant has not submitted any additional documentation or other evidence to dispute the Respondent’s assertions as to the invoices totaling $804.64 or to support its claim that it should be paid for the services billed in the disputed invoices.
It is the opinion and recommendation of the Legislative Claims Commission that the Claimant should be awarded only the sum of $2,419.92 in payment of professional services rendered during the terms of the contract and purchase order.
